Insurance coverage often turns on the state of mind of the policyholder.  For example, did they act ‘fraudulently´, ‘deliberately’  or ‘recklessly’, or were they merely ‘careless’?.  This session will explore the meaning of these different states of mind (and others) in an insurance context. We will consider the impact on:

• common policy exclusions and conditions
  
• pre-inception duties for both consumers and non-consumers
• fraudulent and exaggerated claims
