Learning objectives:

By the end of this webinar, delegates should be able to:

 

  • Explain the recent landmark judgment in Saúl Luciano Lliuya v RWE and its implications for future climate litigation;
  • Outline the court’s evolving approach to witness memory and the requirements for trial witness statements under Practice Direction 57AC; and

  • Discuss damages for late payment under section 13A of the Insurance Act 2015, with insights from the two key judgments handed down to date.

Presenters - Denise Eastlake, Rachel Auld and Esther Zhu

Denise is a Partner at Indemnity Law with over 17 years’ experience advising on complex and high-value property damage, business interruption, construction, products, and public liability losses. She also has particular expertise in climate change risks and the coverage issues that arise from them.

Rachel is a Senior Associate at Indemnity Law. A former advisor to insurers, she has particular expertise in resolving financial lines and commercial property coverage disputes.

Esther is an Associate at Indemnity Law. She advises on complex and high-value claims across a wide range of insurance types. She is fluent in both English and Mandarin.
